1. Definitions
Client refers to the individual, company, or representative engaging CCC
Engineering Pty Ltd (“CCC Engineering”) for mechanical, electrical, or hydraulic design
services.
FastCert System refers to CCC Engineering’s proprietary process for delivering
certifier-ready documentation within 48 hours, as described in the offer.
Project refers to the specific job or scope of work agreed between CCC
Engineering and the Client.
Certifier refers to the appointed building certifier, surveyor, or authority
responsible for plan approval.
2. Scope of Work
2.1 Services Provided
CCC Engineering will provide mechanical, electrical, and hydraulic design documentation in
accordance with the agreed project brief and industry standards.
2.2 Inclusions
- Design documentation required for certifier approval.
- One coordination review with the Client prior to submission.
- Revisions limited to design errors identified by CCC Engineering.
2.3 Exclusions
The scope does not include site inspections, construction administration, or additional redesigns
resulting from changes made by the Client, builder, or certifier after submission.
3. Delivery Timeframes
3.1 Guaranteed Delivery
CCC Engineering guarantees delivery of the initial certifier-ready package within 48 business
hours from the time all required project information is received and confirmed complete by CCC
Engineering in writing.
3.2 Certifier-Ready Definition
“Certifier-ready” means that all documentation required for building certifier submission is
complete and compliant to the best of CCC Engineering’s knowledge based on the information
provided by the Client.
3.3 Client-Caused Delays
Any delay caused by incomplete, inaccurate, or late information from the Client will extend the
delivery timeframe.
4. Client Responsibilities
4.1 Client Obligations
- Provide all required inputs, including architectural drawings, site plans, and
specifications before commencement.
- Nominate a single point of contact for design coordination.
- Review and approve all documentation within 24 hours of receipt to maintain schedule.
4.2 Liability for Information
CCC Engineering is not liable for delays, rework, or additional costs caused by missing or
inaccurate information provided by the Client.
5. Fees and Payment Terms
5.1 Pricing
The FastCert System™ service is billed at a fixed price agreed prior to commencement.
5.2 Payment Schedule
- 50% deposit due upon acceptance of proposal.
- Remaining 50% due upon delivery of certifier-ready documentation (before release of final
files).
5.3 Invoice Terms
Invoices are payable within 7 calendar days.
6. Revisions and Rework
6.1 Design Errors
CCC Engineering will correct any internal design error identified within 10 business days of
notification at no additional charge.
6.2 Chargeable Rework
Rework requested due to the following will be billed at CCC Engineering’s standard hourly rates:
- Changes in Client design intent.
- New or revised architectural drawings.
- Certifier comments not related to design error.
6.3 Approval of Additional Work
All additional work outside the agreed scope must be confirmed in writing prior to commencement.
7. Certifier Interaction and Liability
7.1 Professional Standards
CCC Engineering will design in accordance with applicable codes and standards to the best of its
professional ability.
7.2 Certifier Approval
“Certifier-approved” refers to approval of documentation that complies with applicable codes
based on the information provided. CCC Engineering cannot guarantee certifier approval where:
- The certifier’s interpretation of codes differs; or
- Incomplete or inaccurate project information was supplied.
7.3 Third-Party Decisions
CCC Engineering is not liable for any loss, cost, or delay resulting from third-party
certification decisions beyond its control.
8. Performance Guarantee
8.1 Guarantee Conditions
CCC Engineering guarantees delivery of the certifier-ready package within 48 business hours,
provided all required information is received upfront and no scope changes occur.
8.2 Service Credit
If CCC Engineering fails to deliver within the agreed 48-hour window (excluding delays caused by
the Client or third parties), the Client will receive a $1,000 service credit applied to their
next project.
8.3 Limitation of Compensation
This credit represents full and final compensation for any delay claim.
9. Intellectual Property
9.1 Ownership
All design documents, drawings, and calculations remain the intellectual property of CCC
Engineering until full payment has been received.
9.2 License
The Client receives a non-exclusive license to use the documentation for the specific project
upon full payment.
10. Limitation of Liability
10.1 Liability Cap
CCC Engineering’s total liability, whether in contract, tort, or otherwise, is limited to the
total fees paid by the Client for the specific project.
10.2 Excluded Losses
CCC Engineering is not responsible for indirect, consequential, or economic losses, including
lost profits, penalties, or delay costs.
10.3 Indemnity
The Client agrees to indemnify CCC Engineering against all claims arising from misuse,
misinterpretation, or modification of documentation after delivery.
11. Confidentiality
Both parties agree to keep confidential all project data, drawings, pricing, and proprietary
methods shared during the engagement.
12. Termination
Either party may terminate the agreement with written notice if the other breaches material terms
and fails to remedy within 7 days. Upon termination, all completed work to date will be invoiced
and payable immediately.
13. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, and any disputes shall be
resolved under that jurisdiction.
14. Acceptance
By confirming a project proposal, paying a deposit, or engaging CCC Engineering for services, the
Client agrees to these Terms and Conditions in full.
